This scale may never be applied

Reading time: 1 minJulien Lausson Julien LaussonReading time: 1 min Julien Lausson Julien LaussonThe private copying commission has established the scale it wishes to see applied to refurbished tablets and phones. The levy ranges from 30 cents to 9.1 euros depending on the storage capacity.

While the parliament is moving towards excluding refurbished smartphones and tablets from the scope of the private copying levy, the commission which implements it work acts as if nothing had happened: on June 1, it adopted a scale. However, this could prove to be obsolete if the national representation decides to exempt these devices from this device financing the cultural environment.

For the time being, this scale is not yet applied. The decision of the commission must indeed first appear in the Official Journal. However, a few weeks may pass between the decision itself and its publication in the Official Journal. In addition, there is a delay between the moment when the decision appears and the moment when it becomes effective and is reflected in the selling price of the equipment.

The rule that has been applied to determine the amount of remuneration for private copying is a reduction of 35% for tablets and 40% for phones, based on the scale provided for non-reconditioned devices. The amount depends on the nominal recording capacity, which ranges from 135 MB (yes) to more than 64 GB for mobiles, and from 16 to 64 GB and more for tablets.
